The person who has registered on the Site and adds balance or buys services. The Buyer's name, email and contact details are those given at registration and payment.
Article 2 — Subject
This agreement sets out the rights and obligations of the parties regarding account balance bought electronically on https://orcasmm.com and the digital social media services ordered with that balance, under the Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation.
Article 3 — Service and price
- Service: adding account balance and buying the digital services listed on the Site (followers, likes, views, etc.) with that balance.
- Price: the amount shown on the payment screen and approved by the Buyer, all taxes included. Service prices are those published on the Site at the time of the order.
- Payment: paid in advance by credit/debit card (via Shopier) or the other payment methods offered on the Site.
- Delivery: there is no physical delivery. Balance is credited to the Buyer's account electronically once the payment is confirmed; services are performed electronically after an order is placed.
Article 4 — Pre-contract information
The Buyer confirms having read and understood the Seller's details, the main features of the service, the total price including taxes, payment and performance terms, and the cases in which the right of withdrawal does not apply, and having approved them electronically.
Article 5 — Right of withdrawal
Under Article 15/1 (ğ) and (h) of the Distance Contracts Regulation, there is no right of withdrawal for services performed instantly in electronic form and for services whose performance has started with the consumer's approval before the withdrawal period ends. By placing an order the Buyer approves that performance starts immediately.
Refunds of unused balance and order cancellations are subject to the Refund Policy.
Article 6 — Obligations
- The Seller credits confirmed payments to the Buyer's balance and processes orders according to the service descriptions.
- The Buyer is responsible for the accuracy of order details (link, quantity) and for complying with the Terms of Service.
- If a payment is reversed by the payment provider or bank, or charged back, the Seller may cancel the related balance and the orders placed with it.
Article 7 — Force majeure
Neither party is liable for delays caused by events outside their control such as natural disasters, war, epidemics, internet outages or technical changes made by social media platforms. Orders that cannot be performed in such cases are refunded to balance.
Article 8 — Disputes
Disputes are handled by the Consumer Arbitration Committees within the monetary limits announced each year by the Turkish Ministry of Trade, and by the Consumer Courts above those limits. This does not take away any mandatory consumer rights under the law of the Buyer's country of residence.
Article 9 — Effect
The Buyer accepts all terms of this agreement by approving it on the payment page; it takes effect when the payment is completed. The current version is published on this page and kept electronically by the Seller.
